Privacy Statement
1. General
The protection of your personal data is important to us. In the following privacy statement we therefore inform you why we collect your data and in what form we process it, in particular in connection with the mandate relationship and its initiation (hereinafter „legal services”), with visits to our website, with marketing activities such as our newsletter, with business relationships with us, e.g. as our supplier, and with application procedures. In addition, within the scope permitted by our professional duty of confidentiality, we inform you about the processing of data of the opponents of our clients and of the parties and informants involved in the matters we handle for our clients.
As the operator of this website, we endeavour to review the offered content carefully and to present it to the best of our knowledge as up-to-date, complete and correct, and to keep it up to date. Nevertheless, any liability arising from the use (or non-use) of the offered information is excluded.

3. Personal data
Personal data is all data that contains individual information about personal or factual circumstances, for example name, address, e-mail address, telephone number, date of birth, age, gender, social security number, video recordings, photos, IP address, invoicing data, voice recordings of persons as well as biometric data such as fingerprints. Sensitive data such as health data or data in connection with criminal proceedings may also be included.
4. Use and processing of the data
We, MAXL & MÖTZ Rechtsanwälte GmbH, collect, process and use your personal data only with your consent or mandate or order for the purposes agreed with you, or where another legal basis exists in accordance with the General Data Protection Regulation (GDPR); this in compliance with the data protection and civil law provisions, in particular the Austrian Data Protection Act (DSG), the GDPR and the Austrian Telecommunications Act 2003 (TKG 2003). Excluded from this is the use for statistical purposes, provided that the data made available has been anonymised.
5. Information and deletion
As a client or generally as a data subject, you have – subject to the duty of legal confidentiality – the right at any time to information about your stored personal data, its origin and recipients and the purpose of the data processing, as well as a right to rectification, data portability, objection, restriction of processing and blocking or deletion of incorrect or unlawfully processed data.
Insofar as changes arise in your personal data, we ask you to notify us accordingly.
You have the right at any time to revoke any consent given for the use of your personal data. Your request for information, deletion, rectification, objection and/or data portability – in the latter case provided this does not cause disproportionate effort – can be addressed to the address of the law firm stated in point 2 of this statement.
If you are of the opinion that the processing of your personal data by us violates applicable data protection law or that your data protection rights have been infringed in some other way, you have the possibility to lodge a complaint with the competent supervisory authority. In Austria, the Data Protection Authority is competent for this.
6. Data security
The protection of your personal data is ensured by appropriate organisational and technical measures. These measures relate in particular to protection against unauthorised, unlawful or accidental access, processing, loss, use and manipulation.
Notwithstanding our efforts to comply with a consistently appropriately high standard of due diligence, it cannot be ruled out that information you disclose to us via the internet may be viewed and used by other persons.
Please note that we therefore assume no liability whatsoever for the disclosure of information due to errors in data transmission not caused by us and/or unauthorised access by third parties (e.g. hacking attack on an e-mail account or telephone, interception of faxes).
7. Transfer of data to third parties
In order to fulfil your order, it may also be necessary to forward your data to third parties (e.g. opposing party, substitutes, insurance companies, service providers we use and to whom we make data available, etc.), courts or authorities. Your data is forwarded exclusively on the basis of the GDPR, in particular for the fulfilment of your order or on the basis of your prior consent.
Furthermore, we inform you that, in the course of our legal representation and support, facts- and case-related information about you is regularly also obtained from third parties.
Some of the above-mentioned recipients of your personal data are located outside your country or process your personal data there. The level of data protection in other countries may not correspond to that of Austria. However, unless the order given to us requires otherwise, we only transfer your personal data to countries for which the EU Commission has decided that they have an adequate level of data protection, or we take measures to ensure that all recipients have an adequate level of data protection, for which we conclude standard contractual clauses (2010/87/EC and/or 2004/915/EC).
8. Notification of data breaches
We endeavour to ensure that data breaches are detected at an early stage and, where applicable, reported without delay to you or the competent supervisory authority, including the respective categories of data affected.
9. Retention of data
We will not retain data for longer than is necessary to fulfil our contractual, legal and professional obligations and to defend against any liability claims.
Data of applicants who are not hired will be deleted six months after the conclusion of the application procedure, unless we ask them for their consent to retention on record.
10. Cookies
Our website uses „cookies” in order to make our offer more user-friendly, effective and secure.
A „cookie” is a small text file that we transmit via our web server to the cookie file of the browser on your computer’s hard drive. 12. Web analysis
This website uses Google Analytics, a web analytics service of Google Inc. („Google”). Google Analytics uses so-called „cookies”, text files that are stored on your computer and enable an analysis of your use of the website. The information generated by the cookie about your use of this website is generally transmitted to a Google server in the USA and stored there. In the event that IP anonymisation is activated on this website, however, your IP address will be truncated beforehand by Google within member states of the European Union or in other states party to the Agreement on the European Economic Area. 13. Server log files
In order to optimise our website with regard to system performance, user-friendliness and the provision of useful information about our services, the provider of the website automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. This data is not merged with personal data sources. We reserve the right to check this data subsequently if we become aware of concrete indications of unlawful use.
